1. Acceptance
By accessing or using the Rush Fifty Something Tour Setlist Tracker (the "site"), you agree to these Terms. If you do not agree, stop using the site.
2. Unofficial status
The site is an unofficial, independently operated, fan-created project. It is not affiliated with, sponsored by, authorized by, or endorsed by Rush, Rush Productions, The Anthem Entertainment Group Inc., S.R.O. Management Inc., setlist.fm, or any venue, promoter, ticketing provider, or their respective affiliates.
3. Trademarks and third-party rights
"RUSH", the Rush name and logos, song and album titles, tour names, artwork, photographs, and related marks and content remain the property of their respective owners. References on this site are used only as reasonably necessary for identification, news, commentary, analysis, and fan discussion. No ownership, sponsorship, or endorsement is claimed. Nothing on this site grants any user a license to third-party intellectual property.
4. Setlist and third-party sources
Completed setlist information may be obtained in part from setlist.fm and other sources. When setlist.fm data is used, it is attributed with source links. The tracker uses validation checks and independent cross-checks before incorporating source information into its classifications, statistics, forecasts, and other analysis. Tracker-generated rotation labels, classifications, statistics, forecasts, and commentary are independent analysis and are not setlist.fm content. Source information may later be corrected, delayed, incomplete, or inaccurate. Your use of setlist.fm and other third-party sources remains subject to those parties' own terms.
5. Official information and no reliance
This site is not an official source for dates, cancellations, postponements, start times, venues, tickets, or access policies. You must verify time-sensitive information at rush.com and with the official venue or ticketing provider. Do not rely on the tracker for ticket purchases, travel, lodging, entry, financial decisions, safety decisions, or other consequential actions.
6. Forecasts and editorial analysis
Predictions, rotation labels (Setlist A through G), frequency categories, statistics, and commentary are estimates and editorial analysis and may be wrong. Nothing on the site is a representation that a particular song, setlist, date, or event status will occur.
7. No warranties
The site and its content are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including without limitation warranties of accuracy, completeness, availability, non-infringement, merchantability, and fitness for a particular purpose.
8. Limitation of liability
To the fullest extent permitted by law, the site operator is not liable for any direct, indirect, incidental, special, consequential, or exemplary losses arising from your use of, inability to use, or reliance on the site, including errors, omissions, interruptions, source-data changes, or third-party sites — including ticket, travel, or lodging costs, lost opportunities, data loss, or other consequential damages. Some jurisdictions do not allow all of these exclusions, so these limitations apply only to the extent permitted by applicable law.

11. Acceptable use
You agree not to use the site unlawfully, to impersonate any person or entity, to imply false endorsement, to interfere with or disrupt the site, to circumvent security or access controls, to conduct security testing without permission, to submit automated or manipulated poll votes, or to scrape or send requests in a way that abuses or overloads the service.
12. User submissions
The site does not accept user-uploaded posts. Favorites and poll selections are stored to power features such as the setlist matcher and the fan poll and are not published as attributed user content. If a Contact page is enabled, messages you choose to send through it are transmitted for the purpose of responding to your inquiry.
13. Changes and termination
The site, its features, its data, and these Terms may be modified, corrected, suspended, or discontinued at any time. Updated Terms are effective when posted. Continued use of the site indicates acceptance of the then-current Terms.
14. Governing law and venue
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. To the extent legally enforceable, the exclusive venue for any dispute is the state or federal courts located in Nassau County, New York. If any provision of these Terms is held invalid or unenforceable, that provision will be severed and the remaining provisions will remain in effect.
